With this document (“Information”), the Data Controller, as defined below, wishes to inform you about the purposes and methods of the processing of personal data and the rights recognised by Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and their free movement (“GDPR”). This information may be supplemented by the owner if any additional services requested by the user should involve further processing.

A) Source of personal data

The data held by the company is collected directly from the data subject. In the case of data collection by third parties, the information in question will be sent to them at the time of their registration. All data collected will be processed in accordance with GDPR 679/2016 and D.l. 196/2003 as amended by Legislative Decree 101/2018.

 

B) Purpose of the processing for which the data are intended and duration of processing

C) Categories of persons to whom the data may be communicated

Your data may be communicated by us as far as their respective and specific competence is concerned, to the Bodies and in general to any public and private body with respect to which there is an obligation or need for communication for us and this also for the purposes of the most correct fulfilment of any respective obligation (even of an instrumental nature) in any case connected or referable to the contract.
Your data may also be communicated by us to external parties who carry out specific tasks on behalf of our company (e.g. certification of financial statements, management of information systems, delivery of correspondence) to banks and/or specialized companies for the management of collections and payments deriving from the execution of contracts; to bodies, consortia or associations for the purposes of credit protection, therefore any refusal to provide them would make it impossible to carry out any agreed activity.

 

D) Art. 13 Rights of the interested party

In relation to the data subject to the processing referred to in this information notice, the data subject is entitled at any time to the right to:

– Access (art. 15 EU Regulation n.2016 / 679);
– Correction (art. 16 EU Regulation no. 2016/679);
– Annulment (Article 17 EU Regulation No 2016/679);
– Restriction (Article 18 EU Regulation No 2016/679);
– Portability, understood as the right to obtain data from the data controller in a structured format in common use and readable by an automatic device to transmit them to another controller without hindrance (art. 20 EU Regulation no. 2016/679).

What rights do you have as an interested party

Right of access

Article 15 GDPR: right to obtain confirmation that personal data concerning you is being processed and, in this case, to obtain access to your personal data, including a copy thereof.

Right to limitation of processing

Article 18 GDPR: right to obtain the restriction of processing, when:
1. the data subject contests the accuracy of the personal data, for the period necessary for the owner to verify the accuracy of such data;
2. the unlawful processing and the data subject objects to the deletion of the personal data and requires instead that their use be restricted;
3. personal data are necessary for the data subject to ascertain, exercise or defend a right in court;
4. the data subject has opposed the processing pursuant to art. 21 GDPR, during the waiting period for the verification of the possible prevalence of legitimate reasons of the data controller over those of the data subject.

 

Right to data portability

Article 20 GDPR: right to receive, in a structured, commonly used and readable format by an automated device, the personal data concerning you provided to the Data Controller and the right to transmit them to another data controller without hindrance, if the processing is based on consent and is carried out by automated means. You also have the right to have your personal data transmitted directly by the Bank to another data controller if this is technically feasible.

 

Right of opposition

Article 21 GDPR: right to object, at any time on grounds relating to his or her particular situation, to the processing of personal data relating to him or her on the basis of a legitimate interest or the performance of a task carried out in the public interest or the exercise of public authority, including profiling, unless there are legitimate reasons for the controller to continue processing which override the interests, rights and freedoms of the data subject or for the assessment, exercise or defence of a right in court. Furthermore, the right to object at any time to the processing where personal data are processed for direct marketing purposes, including profiling, insofar as they are related to such direct marketing.
The above rights may be exercised against the Data Controller by contacting the references described above. You may exercise your rights as a data subject free of charge in accordance with Article 12 of GDPR. However, in case of manifestly unfounded or excessive requests, also due to their repetitiveness, the Data Controller may charge a reasonable expense fee, in light of the administrative costs incurred in handling the request, or deny the fulfilment of the request.

 

Right of revocation

Revoke consent, at any time, as easily as it was given, subject to the lawfulness of the processing based on the consent given before the revocation.

 

Right to complain

The person concerned has the right to lodge a complaint with the Data Protection Authority, Piazza di Montecitorio n. 121, 00186, Rome (RM).
